Mainstay Tulare Asphalt Paving provides asphalt paving, sealcoating, repair, and related services to residential and commercial customers in Tulare, CA and surrounding areas. The specific scope of work for any project will be set out in a written estimate or service agreement provided to the customer before work begins. These Terms and Conditions apply to all services we provide.
All estimates are provided in writing and reflect the scope of work discussed at the time of the site visit. Estimates are valid for 30 days from the date issued unless otherwise stated.
Final pricing may change if the actual scope of work differs materially from what was assessed at the time of the estimate - for example, if hidden base damage is discovered during excavation, if site conditions have changed, or if the customer requests changes to the original scope. We will notify you of any changes before proceeding with additional work.
Prices are subject to change due to fluctuations in material costs, fuel, or labor rates. Any estimate provided is based on conditions at the time it was issued and is not a guaranteed fixed price beyond the 30-day validity period.
Once a project date is scheduled, we ask that you provide at least 48 hours notice if you need to reschedule. We reserve the right to reschedule work due to weather conditions, material availability, or other circumstances outside our control. We will contact you promptly if a scheduled date needs to change.
If you cancel a confirmed project after materials have been ordered or a crew has been allocated specifically for your job, we reserve the right to charge a cancellation fee to cover reasonable preparation costs. Any applicable cancellation terms will be stated in your written estimate or service agreement.
Payment terms will be stated in your written estimate or service agreement. For most residential projects, payment is due in full upon completion of the work. For larger commercial projects, a deposit may be required before work begins, with the balance due upon completion.
Accepted payment methods will be communicated at the time of estimate. Late payments may be subject to a late fee as stated in the service agreement. We reserve the right to pursue collection of unpaid balances through legal means if necessary.
Disputes about invoiced amounts must be raised within 10 business days of invoice receipt. Paying an invoice without raising a dispute constitutes acceptance of the charges.
You agree to provide safe and reasonable access to the work area on the scheduled date. This includes moving vehicles, clearing personal property from the work area, and ensuring the site is accessible to our crew and equipment.
You are responsible for marking or identifying any underground utilities, irrigation lines, or other obstructions before work begins. Mainstay Tulare Asphalt Paving is not responsible for damage to unmarked underground features. If you are unsure of underground utility locations, contact the appropriate utility locating service before the project date.
We stand behind the quality of our workmanship. If a defect in our work appears within a reasonable time after project completion and under normal use conditions, contact us and we will evaluate the issue. Any workmanship warranty terms specific to your project will be stated in your written service agreement.
Warranties do not cover damage caused by tree roots, soil movement beyond normal settling, flooding, vehicle damage, improper use, or conditions outside the scope of the work we performed.
Asphalt is a natural material that will experience normal aging over time, including minor surface cracking, fading, and wear. This is not a defect. We recommend regular sealcoating and maintenance to extend the life of your asphalt. Failure to perform recommended maintenance may void workmanship warranty claims.
To the maximum extent permitted by applicable law, Mainstay Tulare Asphalt Paving is not liable for any indirect, incidental, special, or consequential damages arising from our services or your use of our website, including but not limited to lost profits, loss of use, or property damage not directly caused by our negligence.
Our total liability for any claim arising from a project will not exceed the amount you paid us for that specific project. Nothing in these terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
